Who Is Actually Advising You on a Gold IRA Rollover?

Gold IRA Update · September 10, 2026

The federal standard used to decide when someone becomes an investment-advice fiduciary changed during 2026. Following court decisions that vacated the Department of Labor's 2024 Retirement Security Rule, the department restored its longstanding five-part test. The restored framework became effective April 20 and is used to determine when compensated retirement recommendations, including certain rollover recommendations, create a fiduciary relationship. Read the Department of Labor announcement.

The practical point is that not everyone discussing a Gold IRA is automatically acting as a fiduciary. The nature of the relationship, whether advice is provided regularly, the parties' understanding and how the recommendation will be used can all matter. Before acting, a customer should ask: Are you acting as a fiduciary? How are you compensated? Who administers the IRA? Who determines product eligibility? Where will the metals be stored?

Pryce House acts as the precious-metals dealer, not the customer's financial adviser or IRA custodian. The custodian establishes and administers the account, while an approved depository stores the IRA-owned metals. Customers ready to purchase eligible physical metals through an established self-directed account may visit the Pryce House Gold IRA desk.

This article provides general information about the current federal framework. It is not legal, tax, fiduciary or investment advice.
